01 Nature of Services
Day Trade Setup provides licenses to use software, chart analysis tools, TradingView indicators, alert signals, user guides, community channels, and other support services according to the package purchased by the customer.
Day Trade Setup's products and services are provided solely as tools to support market analysis. They do not constitute investment advice, a solicitation to invest, a guarantee of profit, or investment fund management on behalf of customers.
02 Conditions of Use
Customers must provide accurate, complete, and up-to-date information when registering or purchasing products. If any information provided is inaccurate, Day Trade Setup reserves the right to immediately suspend or refuse service.
Customers are solely responsible for their TradingView account, email account, Telegram account, Discord account, and any other channels used in connection with Day Trade Setup's services.
Day Trade Setup shall not be liable for any damage resulting from incorrect information, loss of account access, or unauthorized access to a customer's account by another person.
03 Software License
Upon successful payment, Day Trade Setup grants the customer a personal, non-exclusive, non-transferable, and non-resalable license to use the applicable product or service.
Customers may not copy, modify, reverse engineer, decode, distribute, publish, resell, transfer, rent, lease, or commercially exploit any software, indicator, signal, screenshot, guide, content, or information belonging to Day Trade Setup without prior written authorization from Day Trade Setup.
If a violation is detected, Day Trade Setup reserves the right to immediately suspend, terminate, or revoke the customer's access without a refund. Day Trade Setup also reserves the right to take legal action where such violation causes damage or loss.
04 Payment
Customers must pay the price displayed on the website or stated in the applicable quotation at the time of purchase.
Product and service prices may be changed at any time without prior notice. However, such changes will not affect orders for which payment has already been successfully completed.
Payments processed through third-party service providers, including Stripe or other payment channels, are subject to the terms and conditions of the relevant payment provider.
Day Trade Setup shall not be liable for payment delays, declined transactions, technical failures, or other issues arising from third-party payment systems.
05 Service Activation
After successful payment, customers must provide the required information, such as their email address, TradingView username, or any other information requested by Day Trade Setup, in order to activate access to the service.
The activation period may vary depending on the package, system, and business hours. Day Trade Setup will process activation within a reasonable period and as quickly as reasonably possible.
If the customer provides incorrect, delayed, or incomplete information, Day Trade Setup shall not be responsible for any resulting activation delay. Such delay shall not constitute grounds for a refund.
06 Investment Risk and Limitation of Liability
Indicators, alert signals, analytical systems, and any other information provided by Day Trade Setup cannot guarantee future results, profits, accuracy, or win rates. Past performance does not guarantee or indicate future results.
Customers must exercise their own judgment and conduct their own assessment before making any investment or trading decision.
Day Trade Setup shall not be liable for any profit, loss, financial damage, or other consequences arising directly or indirectly from the use of Day Trade Setup's products or services.
07 Prohibited Uses
Customers agree not to engage in any of the following activities:
- Sharing access rights or licenses with another person;
- Forwarding or distributing signals, screenshots, or information from private member groups;
- Using Day Trade Setup's information to create groups, provide training, resell content, or generate income;
- Attempting to reverse engineer, copy, decode, or modify any software;
- Using the services for unlawful, fraudulent, deceptive, or misleading activities;
- Damaging or attempting to damage Day Trade Setup's systems, website, brand, or reputation.
If a violation is detected, Day Trade Setup reserves the right to immediately suspend or terminate the service without a refund under any circumstances.
08 Modification, Suspension, or Termination of Services
Day Trade Setup reserves the right to improve, modify, add, remove, suspend, or discontinue any feature or part of the services as reasonably necessary to develop the system, improve service quality, correct errors, or comply with legal and regulatory requirements.
Day Trade Setup does not guarantee that the services will be available continuously, uninterrupted, or free from errors.
Service availability may be affected by external platforms and service providers, including TradingView, Telegram, Discord, brokers, Stripe, internet service providers, or other third-party systems.
09 Intellectual Property
All content, software, indicators, code, systems, brand names, logos, illustrations, videos, guides, text, and information available on the website or within the services are the intellectual property of Day Trade Setup or its licensors.
Customers may not use, reproduce, distribute, publish, modify, or commercially exploit such intellectual property without prior written authorization.
10 Account Suspension or Termination
Day Trade Setup reserves the right to immediately suspend, restrict, or terminate a customer's access if the customer:
- Violates these Terms of Service;
- Provides false or misleading information;
- Uses the services for an unauthorized purpose;
- Infringes intellectual property rights; or
- Engages in any activity that may cause damage to Day Trade Setup or other customers.
Any suspension or termination under this section shall not entitle the customer to a refund, unless Day Trade Setup, at its sole discretion, determines otherwise in an exceptional case.
11 Governing Law and Dispute Resolution
Any dispute arising from or relating to the use of the services shall first be resolved through good-faith negotiation or mediation between the parties.
If the parties are unable to reach an agreement, the dispute shall be submitted to the jurisdiction of the competent courts and handled in accordance with applicable law.
